Drafting of legislation
After the restoration of the independence of the republic of Lithuania, new legal base for land management and administration, land reform, real property cadastre, geodesy and cartography had to be set up. In 17 years of independence laws have been enacted in order to regulate:
• land ownership, keeping, and usage relations, as well as land administration and management;
• method of land reform, that is, how goals of land reform should be implemented: implement the right to land ownership of the citizens of Lithuania, by restoring expropriated land and purchasing it according to the law; create legal, organizational and economic preconditions to develop agricultural production by freely choosing the form of farming;
• the order and conditions of acknowledgement of continuity of restoration of the rights of ownership (taking into account the already established objective public property relations) of citizens of the republic of Lithuania, who had their property illegitimately nationalised or otherwise wrongfully expropriated according to the former Soviet Union laws, and who have their ownership rights being restored according to the law of the Republic of Lithuania “On the order and conditions of restoration of the rights of ownership of citizens to existing real property”;
• real property recorded in the real property register of the Republic of Lithuania, estimation of cadastre data, entering the data into real property cadastre, the status of real property cadastre,
establishment, maintenance, reorganization, and liquidation of the cadastre, operational conditions of land surveyors, their rights, duties and responsibilities;
• management of geodetic, topographical, cartography works, principles of composition of geographical information system databases and their integrity, ownership rights of geodetic framework and cartographical data, main rights and duties in the field of geodesy and cartography for state and municipal institutions as well as natural and legal persons, and enterprises established in the countries of the European Economic Area that pursue activities related to cartography, geodetic measurements, storing, accounting, and use of this data in the republic of Lithuania.
The activities of the National Land Service are regulated by these main laws:
• Land law
• Law on land reform
• Law on restoration of the rights of ownership of citizens to existing real property
• Provisional law on acquisition of land for agricultural purposes
• Law on real property cadastre
• Law on geodesy and cartography
For the proper implementation of these laws, the National Land Service has prepared projects of resolutions of the Government of the Republic of Lithuania and other legislation.
The fact that legal base of the activities of the National Land Service is developed and enhanced further according to recent events, is a merit of qualified staff.
